TERMS AND CONDITIONS OF SALE

Purchases of products made on Ogat.com (the “Website”) are governed by the following conditions (the “Terms”).
By clicking the “accept” button, the user (the “User”) accepts the Terms without limitation or reservation.
The Website is owned by Pixartprinting S.p.A. a socio unico, under the direction and coordination of Cimpress plc, with registered office in via 1° Maggio, 8, 30020 - Quarto d’Altino (VE), Italy, VAT number IT04061550275, Tax Code 04061550275 (the “Seller”).

Purchases of Products made by individual Users are subject to consumer regulations pursuant to Italian Legislative Decree no. 206 of 06.09.2005 (the “Consumer Code”).

1. Products Offered on the Website

1.1 The Website allows the purchase of garments, including t-shirts, sweatshirts, and trousers (the “Products”), delivered to the User’s address via postal delivery services exclusively within the Italian territory, unless otherwise permitted by the Seller from time to time.

1.2 The Products shown on the Website are marketed under the Ogat brand and other brands lawfully available to the Seller.

1.3 The characteristics of each Product are detailed in the relevant product page on the Website. Some images are provided for illustrative purposes only and may differ from the delivered Product. Product sizes are based on standard measurements as indicated in the size guide available on the Website.

1.4 To preserve the quality of the print and fabric, the Seller recommends washing printed garments at 30°C, avoiding aggressive detergents, ironing inside out, and following the care instructions provided on the garment.

1.5 All final prices of Products displayed on the Website are expressed in euros. Product prices may vary periodically. For certain Products and offers, shipping costs are included. For all others, shipping costs are borne by the User.

2. Product Selection, Order and Purchase Procedure

2.1 The information and details on the Website do not constitute an offer: they are merely an invitation to Users to submit purchase orders. The User’s proposal to purchase Products is made by submitting the electronic order form at the end of the Website’s order process, as described below.

2.2 To purchase Products, the User may register on the Website in the dedicated area or proceed as a "guest" without registration. Once on the Website, the User may select the desired Products, as described in each product page, and add the desired quantities to the shopping cart. After selection, an order summary page will appear with the total price, including any applicable shipping costs.

2.3 Once the order is submitted, the User will receive an order confirmation detailing the types of Products ordered, their price, any applicable taxes, shipping costs, and the chosen payment method. The contract is considered concluded and binding when the Seller sends the order confirmation to the User’s email address provided during the order process. Ownership of the Products passes to the User upon delivery to the courier, while the risk transfers upon actual delivery to the User.

2.4 The Seller reserves the right, at its sole discretion, not to process any order, including if:

  • the information provided by the User is incomplete or incorrect;

  • the User does not meet the payment requirements;

  • the ordered Products are unavailable.

In such cases, the Seller will notify the User via email that the order proposal has not been accepted (in whole or in part), stating the reasons, and the contract will not be concluded. The Seller will refund any amounts already paid by the User.

2.5 The contract will be stored and made accessible to the User.

3. Payments

3.1 The User may purchase Products online and make payments using the methods indicated on the Website, following the purchasing instructions. Payment information will be transmitted via encrypted protocols to the payment service provider appointed by the Seller, without third-party access. Payments must be made in advance; only after payment will the selected items be placed into production.

4. Delivery and Shipping Times

4.1 Product delivery will be made on the dates selected by the User during checkout.

4.2 As this is a delivery sale, the indicated times are approximate and not guaranteed, as delivery depends on third-party couriers and is calculated from the completion of the order. Delivery dates apply to most of the national territory. Islands and remote areas may require an additional two or more working days.

4.4 The Seller shall not be liable for any damages resulting from delivery delays, which are carried out by third-party couriers.

5. Right of Withdrawal

5.1 Pursuant to Articles 52 et seq. of the Consumer Code, Users who qualify as consumers have the right to withdraw from the contract, without penalties and without giving any reason, within fourteen days of receiving the Products (or, in the case of multiple goods ordered with a single Order and delivered separately, from the day the User or a third party designated by the User acquires physical possession of the last good).

5.2 To exercise the right of withdrawal, the User must inform the Seller of their decision by sending written notice to the following address within 14 days of receipt of the Products:

5.3 Upon exercising the right of withdrawal, the User must return the Products to the Seller without undue delay and in any event within fourteen days of the withdrawal notice. This deadline is met if the User sends back the Products before the fourteen-day period expires.

5.4 The direct cost of returning the Products is borne by the User.

5.5 The User must return the Products in their original and intact condition. Packaging must be adequate to protect the original items from damage or labeling. The User is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, or functioning.

5.6 If the right of withdrawal is exercised in accordance with these provisions, the Seller will refund the User all payments received for the order within fourteen days of receiving the withdrawal notice, using the same payment method used by the User for the original transaction, unless this entails additional costs for the User. However, pursuant to Article 56(3) of the Consumer Code, the Seller may withhold the refund until the goods have been received or the User has provided proof of shipment, whichever comes first.

5.7 In accordance with Article 59(c) of the Consumer Code, the right of withdrawal is excluded for all Products that are made to the User’s specifications or clearly personalized, or that cannot be returned for hygiene reasons and whose seal has been broken after delivery.

6. Lack of Conformity

Users qualifying as consumers may request remedies from the Seller, within the time limits provided by Article 132 of the Consumer Code, for any lack of conformity existing at the time of delivery of the Product.

7. Governing Law, Jurisdiction and Dispute Resolution

7.1 These Terms and any orders placed under them are governed by Italian law.

7.2 Any dispute regarding the interpretation or performance of these Terms and related orders shall be subject to the exclusive jurisdiction of:

  • the Court of Venice (Italy), if the purchase is made by a non-consumer User; or

  • the court of the User’s place of residence or domicile, if the purchase is made by a consumer.
